By submitting photographs or other materials to SamSmruti for digitisation, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, please do not use our services.

5. Handling and Organisation of Photographs
SamSmruti will generally maintain the grouping of photographs submitted by the customer.
Where the customer specifically requests that the order of photographs be maintained in a particular sequence or chronological/event order, we will make reasonable efforts to follow the requested sequence.
However, unless a specific sequencing requirement has been communicated and accepted by SamSmruti in advance, digitised photographs may not retain a particular chronological or event-based sequence. Photographs will, where reasonably possible, remain organised within their corresponding group or batch.
SamSmruti does not undertake to paste or reattach physical photographs into albums after scanning.
6. Protection and Care of Original Photographs
SamSmruti will exercise reasonable care while handling Original Materials. However, physical photographs may be old, fragile, deteriorated, torn, stuck together, or otherwise susceptible to damage during handling or scanning.
By submitting such materials, the customer acknowledges the inherent risks associated with handling and digitising fragile or aged photographs.
Customers are strongly advised to make a backup or other copy of particularly valuable or irreplaceable materials before submitting them to SamSmruti, wherever possible.
7. Limitation of Liability
SamSmruti will take reasonable care of Original Materials entrusted to us.
In the unlikely event that an Original Material is damaged while in our possession due to our handling, our liability, to the extent permitted by applicable law, will be limited to the reasonable basic replacement cost of the damaged physical photograph or material.

Digital Files will be delivered through the method agreed upon with the customer, which may include:

Customers must download and verify their Digital Files within 10 days of delivery and notify SamSmruti promptly of any issue with the delivery.
Unless otherwise agreed, SamSmruti may not be required to retain Digital Files after the applicable retention period described.
10. Digital File Retention and Deletion
SamSmruti generally retains Digital Files on its systems for up to 10 days after delivery to the customer.
After this period, Digital Files may be permanently deleted from SamSmruti's servers and systems.
Customers are therefore responsible for downloading, checking, and securely backing up their Digital Files within the specified period.
Once the applicable retention period has expired, SamSmruti may not be able to recover or reproduce the Digital Files.
11. Privacy and Confidentiality
SamSmruti respects the privacy and confidentiality of customers and their photographs.
We do not intentionally view, disclose, share, publish, or sell customers' photographs to third parties except where such access or disclosure is necessary to provide the requested service, required by law, or otherwise authorised by the customer.
Photographs may necessarily be accessed or handled by authorised members of our team in the course of scanning, processing, quality checking, transferring, storing, or returning the materials.
We take reasonable measures to protect customer materials and Digital Files while they are in our possession or under our control.
12. Copyright and Intellectual Property
The customer retains all copyright and other ownership rights in their photographs and Original Materials.
Submitting photographs to SamSmruti does not transfer ownership or copyright in those photographs to SamSmruti.
The customer grants SamSmruti permission to access, copy, scan, process, store, and transfer the photographs solely to the extent reasonably necessary to provide the requested digitisation services.
The customer is responsible for ensuring that they have the necessary rights and permissions to reproduce the photographs submitted to us.
13. Customer Indemnity
The customer agrees to indemnify and hold SamSmruti harmless from claims, losses, or liabilities arising from the customer's failure to obtain the necessary rights or permissions to reproduce, scan, digitise, or otherwise process the materials submitted to us.
14. Service Limitations
While SamSmruti will make reasonable efforts to provide high-quality digitisation services, the final quality of a Digital File may depend on the condition, age, size, colour, resolution, fading, damage, or other characteristics of the Original Material.
SamSmruti does not guarantee that a digitised photograph will reproduce every aspect of the Original Material exactly as perceived by the customer.
15. Acceptance of Terms
By placing an order with SamSmruti or submitting photographs or other materials for digitisation, the customer confirms that they have read, understood, and accepted these Terms and Conditions.
If the customer does not agree to these Terms and Conditions, they should not submit materials or use SamSmruti's services.
16. Changes to These Terms
SamSmruti reserves the right to update or modify these Terms and Conditions from time to time.
Any updated version may be published on the SamSmruti website and will apply to services ordered after the effective date of the updated Terms, subject to applicable law.
